Polk County Family Court Records

To request a marriage or divorce certificate, applicants can download the appropriate application form from the Polk County Register of Deeds, complete it, attach a valid government-issued photo ID, and submit it by mail or in person at the Register of Deeds office. Alternatively, records may be ordered through the Wisconsin Department of Health Services Vital Records office in Madison.

Access to certified vital records is restricted by Wisconsin law. To check whether a will has been filed or a probate has been opened for a deceased person, the public can search the Wisconsin Circuit Court Access Portal by entering the decedent’s name and selecting Polk County as the jurisdiction.

Polk County recognizes several types of probate proceedings depending on the size and complexity of the estate:

  • Transfer by Affidavit (Small Estate): When the total value of estate assets subject to administration does not exceed $50,000, an interested person may use a small estate affidavit form, available through the Wisconsin State Bar at wisbar.org. This form is not filed with the probate court.
  • Informal Administration: A registrar-supervised proceeding used for many mid-range estates, often without requiring an attorney. Forms are available through the Probate Office or at wicourts.gov.
  • Formal Administration: A judge-supervised proceeding required for complex estates or when disputes arise among beneficiaries. An attorney is required.
  • Summary Settlement: Available when there is a surviving spouse or minor children and the estate does not exceed $50,000 after accounting for secured debts.
  • Summary Assignment: An alternative to summary settlement when the estate value, less secured debts, does not exceed $50,000 and summary settlement criteria are not met.
  • Ancillary Proceedings: Used when the decedent was domiciled in another state but owned property in Polk County. Formal in nature and requires an attorney.

Effective July 1, 2014, testamentary trusts in Wisconsin are no longer subject to ongoing court supervision. However, interested parties may still petition the Circuit Court to address issues arising from a trust, which requires formal proceedings and legal representation.
